How to Buy Refrigerant Legally - EPA 608 & 609 Explained
Under 40 CFR §82.154, only certified technicians and resellers can buy HFC refrigerants. Here's exactly what you need and how to fill out the EPA form.

Since 1994, EPA's Clean Air Act Section 608 has restricted the sale of ozone-depleting and most HFC refrigerants to certified buyers only. If you're a contractor ordering R-410A online, you need to know exactly what's required at checkout so there are no surprises.
Who can legally buy refrigerant
Per 40 CFR §82.154, refrigerant can only be sold to:
- EPA Section 608 certified technicians (Type I, II, III, or Universal) - for stationary HVAC and refrigeration work
- EPA Section 609 certified technicians - for mobile automotive AC service (R-134A, R-1234yf)
- Wholesalers/resellers (who will resell to certified end-users) - must check the wholesaler resale box on the EPA form
- Employer of certified technicians, with the employer attesting the refrigerant will only be used by certified staff
Which refrigerants require certification
At minimum:
- Class I ODS (CFCs, HCFCs - including R-22) - all sales
- Class II ODS (HCFCs) - all sales
- HFCs (R-410A, R-134A, R-404A, R-407C, R-448A, R-449A, R-452A, R-454B, R-32) - all sales
- HFOs pure (R-1234yf) - yes for most suppliers
What you'll provide at checkout
At Delta Refrigerants and any reputable supplier, you'll be asked for:
- Your full name
- Your EPA Section 608 or 609 certification number
- Certification type (I / II / III / Universal / 609)
- Issue date and expiration (many certs don't expire; some state renewal requirements apply)
- Your business name (if applicable)
- Certification that the refrigerant will be used only by certified technicians or resold by you as a wholesaler
What happens to the form
Suppliers must retain the signed certification records for three years and make them available to EPA on request. This isn't a formality - EPA enforcement has increased sharply since 2022. You're helping your supplier stay in compliance, which protects your own supply chain.
No cert? You cannot buy
There is no legal workaround. Homeowners cannot buy refrigerant online for DIY recharge. Suppliers who bypass this rule risk license loss and EPA penalties - we don't, and you shouldn't trust one who does.
