1. Acceptance of Terms
By accessing or using the website at https://deltarefrigerants.com(the "Site") or purchasing products from Delta Refrigerants LLC("Delta Refrigerants," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Site or place orders.
2. Eligibility - EPA Certification Required
Purchase of regulated refrigerants requires EPA Section 608 or Section 609 certification, or registered wholesaler-resale status, per 40 CFR §82.154. By placing an order, you represent and warrant that you hold a current, valid certification and that all information provided at checkout is accurate. Providing false certification information is a violation of federal law. We may cancel or refuse any order at our sole discretion.
3. Age Requirement
You must be at least 18 years old and legally capable of entering contracts in your jurisdiction to use this Site or place orders.
4. Pricing and Availability
All prices are in US dollars and subject to change without notice. Product availability is not guaranteed. We reserve the right to correct pricing errors, limit order quantities, and refuse orders. Orders are confirmed only after payment authorization and EPA certification verification.
5. Shipping and Delivery
See our Shipping & Returns page for delivery timelines, hazmat packaging, and zone details. Title and risk of loss pass to you upon delivery to the address on file. You are responsible for providing accurate shipping information and accepting delivery.
6. Returns and Refunds
Unopened, factory-sealed cylinders may be returned within 30 days for a refund minus original shipping and a 15% restocking fee. Opened or used cylinders cannot be returned for safety and regulatory reasons. Damaged or defective cylinders are replaced at no charge when reported within 48 hours of delivery.
7. Product Warranty
Every cylinder is warranted to meet AHRI-700 purity standards at the time of sealing. If independent lab testing demonstrates otherwise, we will replace the cylinder and credit reasonable lab costs. No other warranties, express or implied, are provided. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Compliance & Safety
You assume full responsibility for the legal, safe, and proper use of refrigerants you purchase, including compliance with EPA, OSHA, DOT, and applicable state and local regulations. A2L refrigerants (R-454B, R-32) require additional safety training and A2L-rated equipment. Delta Refrigerants is not responsible for improper use, improper storage, or unauthorized modifications.
9. Net-30 Business Terms (if approved)
Approved business accounts may pay by invoice within 30 days of order date. Late payments accrue interest at 1.5% per month (18% APR) or the maximum permitted by law, whichever is less. Credit limits may be adjusted based on payment history and usage. We reserve the right to suspend or terminate Net-30 terms at our discretion.
10. Intellectual Property
All content on this Site - including text, images, logos, and product data - is owned by Delta Refrigerants or its licensors and protected by US copyright and trademark law. You may not reproduce, distribute, or create derivative works without written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Delta Refrigerants' aggregate liability for any claim arising out of your use of the Site or products is limited to the purchase price paid for the specific product giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless Delta Refrigerants, its officers, employees, and agents from any claims, damages, liabilities, or expenses arising out of your use of the Site, products purchased, violation of these Terms, or violation of any law or third-party right.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Fort Bend County, Texas. You waive any objection to venue.
14. Changes to Terms
We may modify these Terms at any time by posting the updated version on this page. Your continued use of the Site after changes constitutes acceptance. The "Last updated" date above reflects the most recent revision.
